( MENAFN - AFP) Japanese Stocks rose Friday on a weaker yen after a muted day on Wall Street following the Christmas holiday. Japan's key NIKKEI index was up more than 1 percent in morning trade, after the yen hit 158.08 per US dollar on Thursday evening -- its lowest level in almost six months. The Nikkei had closed up 1.1. percent on Thursday, boosted by comments from the bank of Japan chief and share price gains for top-selling automaker Toyota. "Today's Japanese market is expected to start with an upswing, continuing the upward momentum of the previous day's Japanese market, driven by the weak yen, while the US market was slightly mixed," said Kosuke Oka, an analyst at Monex Securities. The yen was "marginally stronger" on Friday, Bloomberg reported, after data showed inflation in Tokyo rose for a second month in December. Other positive figures from Japan showed industrial production declined less than expected in November while retail sales came in higher than estimated last month. With the country's unemployment rate holding at 2.5 percent in November -- low by international standards but slightly above Japan's pre-pandemic average -- Moody's Analytics said Friday that the data confirmed their view that "employment conditions are wobbly". Investor attention is now focused "on whether the Nikkei average will expand its rise to recover to the 40,000 points range by the end of the year", added Oka from Monex. Bank of Japan (BoJ) Governor Kazuo Ueda had bewildered observers last week by suggesting a prolonged pause in the institution's monetary policy tightening, in the face of domestic and international economic uncertainties, which had sent the Japanese currency tumbling. On Wednesday, Ueda said rates would be "adjusted" if the situation continued to improve on the economic and price fronts, leaving investors without a clear signal on a possible interest rate hike and contributing to the yen's slide. It looked like a recipe for disaster. So, when his country's swimmers were being accused of doping earlier this year, one Chinese official cooked up something fast. He blamed it on contaminated noodles. In fact, he argued, it could have been a culinary conspiracy concocted by criminals, whose actions led to the cooking wine used to prepare the noodles being laced with a banned heart drug that found its way into an athlete's system. This theory was spelled out to international anti-doping officials during a meeting and, after weeks of wrangling, finally made it into the thousands of pages of data handed over to the lawyer who investigated the case involving 23 Chinese swimmers who had tested positive for that same drug. The attorney, appointed by the World Anti-Doping Agency, refused to consider that scenario as he sifted through the evidence. In spelling out his reasoning, lawyer Eric Cottier paid heed to the half-baked nature of the theory. "The Investigator considers this scenario, which he has described in the conditional tense, to be possible, no less, no more," Cottier wrote. Even without the contaminated-noodles theory, Cottier found problems with the way WADA and the Chinese handled the case but ultimately determined WADA had acted reasonably in not appealing China's conclusion that its athletes had been inadvertently contaminated. Critics of the way the China case was handled can't help but wonder if a wider exploration of the noodle theory, details of which were discovered by The Associated Press via notes and emails from after the meeting where it was delivered, might have lent a different flavor to Cottier's conclusions. "There are more story twists to the ways the Chinese explain the TMZ case than a James Bond movie," said Rob Koehler, the director general of the advocacy group Global Athlete. "And all of it is complete fiction." In April, reporting from the New York Times and the German broadcaster ARD revealed that the 23 Chinese swimmers had tested positive for the banned heart medication trimetazidine, also known as TMZ. China's anti-doping agency determined the athletes had been contaminated, and so, did not sanction them. WADA accepted that explanation, did not press the case further, and China was never made to deliver a public notice about the "no-fault findings," as is often seen in similar cases. The stock explanation for the contamination was that traces of TMZ were found in the kitchen of a hotel where the swimmers were staying. In his 58-page report, Cottier relayed some suspicions about the feasibility of that chain of events — noting that WADA's chief scientist "saw no other solution than to accept it, even if he continued to have doubts about the reality of contamination as described by the Chinese authorities." But without evidence to support pursuing the case, and with the chance of winning an appeal at almost nil, Cottier determined WADA's "decision not to appeal appears indisputably reasonable." A mystery remained: How did those traces of TMZ get into the kitchen? Shortly after the doping positives were revealed, the Institute of National Anti-Doping Organizations held a meeting on April 30 where it heard from the leader of China's agency, Li Zhiquan. Li's presentation was mostly filled with the same talking points that have been delivered throughout the saga — that the positive tests resulted from contamination from the kitchen. But he expanded on one way the kitchen might have become contaminated, harkening to another case in China involving a low-level TMZ positive. A pharmaceutical factory, he explained, had used industrial alcohol in the distillation process for producing TMZ. The industrial alcohol laced with the drug "then entered the market through illegal channels," he said. The alcohol "was re-used by the perpetrators to process and produce cooking wine, which is an important seasoning used locally to make beef noodles," Li said. "The contaminated beef noodles were consumed by that athlete, resulting in an extremely low concentration of TMZ in the positive sample. "The wrongdoers involved have been brought to justice." This new information raised eyebrows among the anti-doping leaders listening to Li's report. So much so that over the next month, several emails ensued to make sure the details about the noodles and wine made their way to WADA lawyers, who could then pass it onto Cottier. Eventually, Li did pass on the information to WADA general counsel Ross Wenzel and, just to be sure, one of the anti-doping leaders forwarded it, as well, according to the emails seen by the AP. All this came with Li's request that the noodles story be kept confidential. Turns out, it made it into Cottier's report, though he took the information with a grain of salt. "Indeed, giving it more attention would have required it to be documented, then scientifically verified and validated," he wrote. Neither Wenzel nor officials at the Chinese anti-doping agency returned messages from AP asking about the noodles conspiracy and the other athlete who Li suggested had been contaminated by them. Meanwhile, 11 of the swimmers who originally tested positive competed at the Paris Games earlier this year in a meet held under the cloud of the Chinese doping case. Though WADA considers the case closed, Koehler and others point to situations like this as one of many reasons that an investigation by someone other than Cottier, who was hired by WADA, is still needed. "It gives the appearance that people are just making things up as they go along on this, and hoping the story just goes away," Koehler said. "Which clearly it has not." The company filed documents in Federal Court in Vancouver on Dec. 5, seeking to set aside the order to wind-up and cease business in Canada. The government ordered the dissolution of TikTok’s Canadian business in November after a national security review of the Chinese company behind the social media platform. That means TikTok must close its operations in Canada, though the app will continue to be available to Canadians. TikTok wants the court to pause the order while it argues its case on why the government’s decision should be overturned. It claims the minister’s decision was “unreasonable” and “driven by improper purposes.” “TikTok Canada provides hundreds of Canadians with well-paying jobs, and contributes millions of dollars annually to the Canadian economy,” the application says. “Through the TikTok platform, Canadian businesses and content creators can reach a global audience of over one billion monthly users.” The review was carried out through the Investment Canada Act, which allows the government to investigate any foreign investment with potential to harm national security. Industry Minister François-Philippe Champagne said in a statement at the time that the government was taking action to address “specific national security risks,” though it didn’t specify what those risks were. TikTok’s court application says Champagne “failed to engage with TikTok Canada on the purported substance of the concerns that led to the (order.)” The company argues the government ordered “measures that bear no rational connection to the national security risks it identifies.” It says the reasons for the order “are unintelligible, fail to reveal a rational chain of analysis and are rife with logical fallacies.” TikTok Canada also claims it “participates in important Canadian public policy issues at the federal and provincial level, including those related to online safety, elections, and culture.” The company’s filing says TikTok Canada “worked with Elections Canada and the Privy Council Office on partnerships to support election integrity on the TikTok platform.” TikTok claims the foreign investment review and economic security branch of Innovation, Science and Economic Development Canada “abruptly” finished the company’s national security review at the end of October, and ordered the company to wind-up its Canadian operations a week later. The company’s court application says there were “less onerous” options available than ordering the shut down, which it claims “will cause the destruction of significant economic opportunities and intangible benefits to Canadian creators, artists and businesses, and the Canadian cultural community more broadly.” The company’s law firm, Osler Hoskin & Harcourt LLP, declined to comment, while Champagne’s office did not immediately respond to a request for comment. Blame it on the food and drink?NoneIn a massive blow to the Northern Territory's ambitious space program, Equatorial Launch Australia (ELA) has ceased operations of the Arnhem Space Centre and announced it would relocate the spaceport to a new site in Queensland. or signup to continue reading The ELA-run spaceport saw NASA launch rockets from Arnhem Land in 2022 - for the first time from a commercial port outside of the US. Now, ELA has laid the blame on the Northern Land Council for having been "forced" to make its decision to abandon the NT site on Gumatj land near the town of Nhulunbuy. "This decision has been forced by the inability of the Company to finalise a lease for the expansion of the Arnhem Space Centre," the company said in a statement. "The decision came after the Northern Land Council (NLC) failed to meet its own specified deadline for the approval of the Head Lease for the fourth time over the last 12 months in October 2024." ELA claims it had made "desperate appeals", together with the Northern Territory Chief Minister's Department and the Gumatj Corporation since February 2024, but the NLC "would not issue a Head Lease or provide any official reasons for the delays". "Accordingly, Management and the Board of ELA were left with no option other than to act in the best interest of its customers and shareholders, abandon negotiations, and seek an alternate equatorial site in Queensland." But the Northern Land Council has hit back to "set the record straight on falsehoods shared by Equatorial Launch Australia". "ELA provided inaccurate, unrealistic timelines and unfairly blamed the NLC for delays as the reason for their decision," the Land Council said in a statement. "The NLC has engaged proactively and positively to facilitate a substantial, swift and, most crucially, safe agreement being made between ASC and Traditional Owners." Under its statutory obligations, the NLC is required to facilitate land use agreements between Aboriginal people and entities wishing to conduct business on their land, across the Top End of the NT. The Land Council said since September 2023 it had been in negotiations with ELA in regards to the planned space centre expansion in Arnhem Land, "consistently request(ing) essential information and terms to be provided, so that it could facilitate informative consultations with all Traditional Owners affected, including progressing the work of independent expert consultants". The NLC said negotiations had been "complicated", alleging ELA's "attempts to circumvent sacred sites protection requirements, breaches of previous agreement conditions, requiring confidentiality agreements, and significantly delaying responses to crucial correspondence". Matthew Ryan, NLC Chair, said it was "vital for Countrymen, and in the interest of all Australians", that sacred and cultural sites are protected and at the same time Aboriginal people are included in and benefit from economic developments on their Country". "Our people will not be pushed into cutting corners for outside business timelines, nor can we jeopardise cultural obligations, our Country, or the hard-won Land Rights of our people," he said. "We stand with our East Arnhem-based Council Members and all the clans of East Arnhem Land, when we say that we are very disappointed with how ELA has handled this. Especially the false timeline they are sharing and how they have obviously been working behind-the-scenes with Queensland - where they don't have the Aboriginal Land Rights Act to make sure Aboriginal Lands are respected and protected, and where they already have that appointed coordinator to dangerously rush things through." Mr Ryan said the NLC had "worked hard" to keep the Arnhem Space Centre's agreement moving, acknowledging the "opportunities the ASC could present to Aboriginal people across the Top End in terms of economic development and education". ELA said it had worked with the Queensland Government to move its spaceport to Weipa, hoping it will have regulatory clearances for contracted launches in late 2025. Meanwhile, the NT Government - a financial supporter of the space port - said it was "exploring legal options regarding our 5 per cent shareholding in ELA", which is believed to be worth about $5 million. In fact, he argued, it could have been a culinary conspiracy concocted by criminals, whose actions led to the cooking wine used to prepare the noodles being laced with a banned heart drug that found its way into an athlete's system. This theory was spelled out to international anti-doping officials during a meeting and, after weeks of wrangling, finally made it into the thousands of pages of data handed over to the lawyer who investigated the case involving 23 Chinese swimmers who had tested positive for that same drug. The attorney, appointed by the World Anti-Doping Agency, refused to consider that scenario as he sifted through the evidence. In spelling out his reasoning, lawyer Eric Cottier paid heed to the half-baked nature of the theory. "The Investigator considers this scenario, which he has described in the conditional tense, to be possible, no less, no more," Cottier wrote. Even without the contaminated-noodles theory, Cottier found problems with the way WADA and the Chinese handled the case but ultimately determined WADA had acted reasonably in not appealing China's conclusion that its athletes had been inadvertently contaminated. Critics of the way the China case was handled can't help but wonder if a wider exploration of the noodle theory, details of which were discovered by The Associated Press via notes and emails from after the meeting where it was delivered, might have lent a different flavor to Cottier's conclusions. "There are more story twists to the ways the Chinese explain the TMZ case than a James Bond movie," said Rob Koehler, the director general of the advocacy group Global Athlete. "And all of it is complete fiction." Something in the kitchen was contaminated In April, reporting from the New York Times and the German broadcaster ARD revealed that the 23 Chinese swimmers had tested positive for the banned heart medication trimetazidine, also known as TMZ. China's anti-doping agency determined the athletes had been contaminated, and so, did not sanction them. WADA accepted that explanation, did not press the case further, and China was never made to deliver a public notice about the "no-fault findings," as is often seen in similar cases. The stock explanation for the contamination was that traces of TMZ were found in the kitchen of a hotel where the swimmers were staying. In his 58-page report, Cottier relayed some suspicions about the feasibility of that chain of events — noting that WADA's chief scientist "saw no other solution than to accept it, even if he continued to have doubts about the reality of contamination as described by the Chinese authorities." But without evidence to support pursuing the case, and with the chance of winning an appeal at almost nil, Cottier determined WADA's "decision not to appeal appears indisputably reasonable." But how did the drugs get into the kitchen? A mystery remained: How did those traces of TMZ get into the kitchen? Shortly after the doping positives were revealed, the Institute of National Anti-Doping Organizations held a meeting on April 30 where it heard from the leader of China's agency, Li Zhiquan. Li's presentation was mostly filled with the same talking points that have been delivered throughout the saga — that the positive tests resulted from contamination from the kitchen. But he expanded on one way the kitchen might have become contaminated, harkening to another case in China involving a low-level TMZ positive. A pharmaceutical factory, he explained, had used industrial alcohol in the distillation process for producing TMZ. The industrial alcohol laced with the drug "then entered the market through illegal channels," he said. The alcohol "was re-used by the perpetrators to process and produce cooking wine, which is an important seasoning used locally to make beef noodles," Li said. "The contaminated beef noodles were consumed by that athlete, resulting in an extremely low concentration of TMZ in the positive sample. "The wrongdoers involved have been brought to justice." New information sent to WADA ... eventually This new information raised eyebrows among the anti-doping leaders listening to Li's report. So much so that over the next month, several emails ensued to make sure the details about the noodles and wine made their way to WADA lawyers, who could then pass it onto Cottier. Eventually, Li did pass on the information to WADA general counsel Ross Wenzel and, just to be sure, one of the anti-doping leaders forwarded it, as well, according to the emails seen by the AP. All this came with Li's request that the noodles story be kept confidential. Turns out, it made it into Cottier's report, though he took the information with a grain of salt. "Indeed, giving it more attention would have required it to be documented, then scientifically verified and validated," he wrote. Neither Wenzel nor officials at the Chinese anti-doping agency returned messages from AP asking about the noodles conspiracy and the other athlete who Li suggested had been contaminated by them. Meanwhile, 11 of the swimmers who originally tested positive competed at the Paris Games earlier this year in a meet held under the cloud of the Chinese doping case. Though WADA considers the case closed, Koehler and others point to situations like this as one of many reasons that an investigation by someone other than Cottier, who was hired by WADA, is still needed. "It gives the appearance that people are just making things up as they go along on this, and hoping the story just goes away," Koehler said. "Which clearly it has not."
TikTok is challenging the federal government’s order to shut down its operations in Canada, claiming it will eliminate hundreds of jobs and potentially terminate a quarter of a million contracts that it has with Canadian advertising clients. The company filed documents in Federal Court in Vancouver on Dec. 5, seeking to set aside the order to wind-up and cease business in Canada. The government ordered the dissolution of TikTok’s Canadian business in November after a national security review of the Chinese company behind the social media platform. That means TikTok must close its operations in Canada, though the app will continue to be available to Canadians. TikTok wants the court to pause the order while it argues its case on why the government’s decision should be overturned. It claims the minister’s decision was “unreasonable” and “driven by improper purposes.” “TikTok Canada provides hundreds of Canadians with well-paying jobs, and contributes millions of dollars annually to the Canadian economy,” the application says. “Through the TikTok platform, Canadian businesses and content creators can reach a global audience of over one billion monthly users.” The review was carried out through the Investment Canada Act, which allows the government to investigate any foreign investment with potential to harm national security. Industry Minister François-Philippe Champagne said in a statement at the time that the government was taking action to address “specific national security risks,” though it didn’t specify what those risks were. TikTok’s court application says Champagne “failed to engage with TikTok Canada on the purported substance of the concerns that led to the (order.)” The company argues the government ordered “measures that bear no rational connection to the national security risks it identifies.” It says the reasons for the order “are unintelligible, fail to reveal a rational chain of analysis and are rife with logical fallacies.” TikTok Canada also claims it “participates in important Canadian public policy issues at the federal and provincial level, including those related to online safety, elections, and culture.” The company’s filing says TikTok Canada “worked with Elections Canada and the Privy Council Office on partnerships to support election integrity on the TikTok platform.” TikTok claims the foreign investment review and economic security branch of Innovation, Science and Economic Development Canada “abruptly” finished the company’s national security review at the end of October, and ordered the company to wind-up its Canadian operations a week later. The company’s court application says there were “less onerous” options available than ordering the shut down, which it claims “will cause the destruction of significant economic opportunities and intangible benefits to Canadian creators, artists and businesses, and the Canadian cultural community more broadly.” The company’s law firm, Osler Hoskin & Harcourt LLP, declined to comment, while Champagne’s office did not immediately respond to a request for comment.
